Miami CF Staff Illegally Restricting Access to Legal Corrrespondence

RE:DEPARTMENTAL STAFF MISCONDUCTS

Dear Commissioner of the Indiana Department of Correction:

On 9/3/2021 I personally sent to the facility law library a request for use of law library asking that the law library, for my court ordered 10-31-2021 notated deadline date, copy my (114) page Corrected "Book of Appendices-Volume 1"; and (4) page "Table of Contents-Volume 1" four (4) times and I requested the following legal supplies to help me mail the legal documents to the intended courts and case parties per law and court rules:"(4) four 10*13 legal Envelopes" and "(50) fifty sheets of blank paper".

Thereon my 9/3/2021 law library request I notated the request if for my pending case litigations under and pursuant to case number 21A-CT-1855. On September 10th, 2021 I received returned, on cameras, the original case documents, law library request form and remittance form that were sent to the facility law library to be processed unprocessed. I also received an undated signed memo from law library staff, Officer S. Hall, that states:

"Policy states that 3 copies will be made for you unless you can provide court documentsstating how many copies and where they are going, there will only be 3 copies made of a document at a time. Policy also states that you will be given 3 envelopes at a time. If you send you legal mail out through the law Library to be checked and mailed other envelopes may be supplied. Library will supply 10 sheets of paper at a time."

Officer S. Hall cites to no policy or policy section(s). Policy 00-01-102 states that officer S. Hall shall not impose restrictions on my correspondences that would obstruct availability of adequate legal representation. I am a pro se litigant- meaning that I'm my own representation. The policy states that "Restrictions on access to the courts, legal counsel, personal legal papers and legal research materials shall be reasonable as necessary for the safety and security of the facility." It is not reasonable or a facility security need of Correctional Officer S. Hall to restrict my access to the requested legal materials and research materials as is hereto reported and has been done for the past month and a half by both Correctional Officers B. Drudge and S. Hall.

The misconducts of Officer S. Hall and B. Drudge violate the following policies of the State of Indiana: 00-00-101; 00-01-102; and 01-01-102; as well as 04-03-103. What is the penological justification of the state personnel violating the employment duties of the cited State policies?

I, on 9-11-2021, have reported this matter to the facility T.I.P.S. line for correction and investigation of the reported misconducts, thus staff accountability. There is not reason for the Miami Correctional Facility personnel in denying me accesses to as hereto reported. I write to you all to notify each of you of the misconducts of staff of the Department so that you may intervene to correct the reported misconducts that violate both State and Federal laws that place civil and criminal liability on the individual state personnel and the State of Indiana Department of Correction for workplace misconducts, harassment(s), discrimination(s), and racism(s) that, as to my knowledge, is not permitted in the workplace. (SEE: POLICY:04-03-103)

I ask that you cause your Miami Correctional Facility State personnel to process all of my request for use of law library (State Form 19704) to the letter of my request thus (MY) legal litigation needs.

I ask that not just for me but for all Miami Correctional Facility confined Men and Women, and the few kids that are here with us, is Correctional Officers B. Drudge and S. Hall certified librarian whom are both trained to properly work in the Facility law library and leisure library departments?

As i have deadlines, some of which B. Drudge and S. Hall have made me miss already due to the hereto reported misconducts, will you immediately reply to this report of staff misconducts by investigation and memo to the Miami Correctional Facility facility personnel that Law Library staff shall process all of my request for the use of the facility law library to the letter of my request, thus legal litigation needs? Will you please forward to me a copy of the memo sent to the Miami Correctional Facility Staff herein requested? Will you please inform me of the status and conclusion on the requested investigation into and on the hereto reported matter?

Please keep in mind and be advised that this matter is of importance and is defined as a critical incident by policy of the State of Indiana.

I also request that you make this document and all files generated in response to it or any portion hereto accessible to the publics both confined and not confined as I am doing and authorize on my behalf?
